Call for Entries: LJRF Center for ADR Article Writing Competition on Mediation Act 2023

INTRODUCTION

As India’s Alternative Dispute Resolution (ADR) realm undergoes a transformative stride with the implementation of the Mediation Act of 2023, the mediation procedures, enforceability, and the status of mediation as a highly effective ADR tool have been streamlined. The LJRF Center for ADR invites contributions to its first ever Article Writing Competition, inviting insights on the revolutionary developments shaping the realm of Alternative Dispute Resolution with this new enactment.

The Process of Mediation


Mediation, a structured process employing specialized communication and negotiation techniques, facilitates amicable dispute resolution through a neutral intermediary. Section 89(1) of the Code of Civil Procedure, 1908 empowers courts to recommend diverse dispute resolution methods, including arbitration, conciliation, judicial settlement, or mediation. Indian courts have actively embraced this provision, contributing to the widespread utilization of mediation in the country’s legal landscape.

The Mediation Act of 2023 is applicable to mediations conducted within India, encompassing cases where all involved parties are based in India. Additionally, its scope extends to situations where the mediation agreement explicitly specifies its applicability. Furthermore, the Act is pertinent to international mediations, provided at least one party involved hails from a country other than India

About the Competition

Topic:- Mediation Act 2023: A Revolutionary Development in the Realm of Alternative Dispute Resolution.


Submission guidelines are as follows:

  1. Articles must be in the English language only.
  2. Font style should be Times New Roman.
  3. Font size should be 12.
  4. Line spacing should be 1.5.
  5. An abstract of 250 words shall be submitted.
  6. The word limit is 2500-3000 words.
  7. Articles must be original and unpublished. However, plagiarism up to 10% is allowed.
  8. The body of the email must specify the name and designation, contact number, and the name of the college/institution of the participant.
